This Orgalim guide helps technology manufacturers comply with the new Data Act regulation 2023/2854, navigate its complexities and use the all-new rights it introduces.
The guide is specially designed to help technology manufacturers navigate the complexities of the Data Act. It provides practical use cases, actionable checklists and helpful diagrams to make the complex process as simple as possible. It also includes extensive checklists for manufacturers (including original equipment manufacturers and suppliers of components) for guidance purposes.
Most of the rights and obligations the Data Act stipulates will apply as of 12 September 2025. Companies that aren’t compliant when the new regulation becomes applicable will face fines.
This guide has been drafted by a multi-disciplinary team of experts from national associations, European associations and single companies within Orgalim’s membership, representing a wide range of industries and entities active in different steps of the value chain of connected products (IoT devices).
The guide focuses especially on Chapters II and III of the Data Act, addressing mandatory data sharing B2B and B2C. It was developed mostly taking into account B2B use cases, but it can provide some support also for compliance in B2C, as the Data Act applies the same regime for both. Its content has been aligned with the guidance of the European Commission available to date, but goes into much further detail specifically for the technology manufacturers in the sectors of mechanical engineering, electronics, electrical engineering, ICT and metal technology.
